		<paragraph><![CDATA[statement. Projects scheduled in the first five years of a ]]></paragraph>
		<paragraph><![CDATA[plan are considered committed and are not re-evalu- ]]></paragraph>
		<paragraph><![CDATA[ated, but projects in the final five years of the 10-year ]]></paragraph>
		<paragraph><![CDATA[plan are prioritized again, along with suggested new ]]></paragraph>
		<paragraph><![CDATA[projects. The Board of Transportation is expected to ]]></paragraph>
		<paragraph><![CDATA[consider final approval of the draft plan this summer. ]]></paragraph>
		<paragraph><![CDATA[See details about STIP projects at the NCDOT website ]]></paragraph>
		<paragraph><![CDATA[The draft STIP includes projects in all 100 counties in ]]></paragraph>
		<paragraph><![CDATA[the state and all modes of transportation. The projects ]]></paragraph>
		<paragraph><![CDATA[break down this way: 1,266 highway, 86 aviation, 235 bi- ]]></paragraph>
		<paragraph><![CDATA[cycle and pedestrian, six ferry, 23 public transit and 47 ]]></paragraph>
		<paragraph><![CDATA[rail. Projects were selected based on technical data, as ]]></paragraph>
		<paragraph><![CDATA[well as input from local officials and residents. ]]></paragraph>
		<paragraph><![CDATA[A few of the major projects in the plan include: ]]></paragraph>
		<paragraph><![CDATA[• Upgrading 15 miles of U.S. 64 to Interstate 87 in ]]></paragraph>
		<paragraph><![CDATA[Nash and Edgecombe counties; ]]></paragraph>
		<paragraph><![CDATA[• constructing part of the U.S. 74 Wadesboro Bypass in ]]></paragraph>
		<paragraph><![CDATA[Anson County; ]]></paragraph>
		<paragraph><![CDATA[• improving I-77 south of Charlotte in Mecklenburg ]]></paragraph>
		<paragraph><![CDATA[County; • constructing the I-26 Connector in Buncombe ]]></paragraph>
		<paragraph><![CDATA[County; • adding a second passenger ferry for the Ocracoke Ex- ]]></paragraph>
		<paragraph><![CDATA[press route between Hatteras and Ocracoke; ]]></paragraph>
		<paragraph><![CDATA[• widening I-40 in Orange County between I-85 to U.S. ]]></paragraph>
		<paragraph><![CDATA[15-501; and ]]></paragraph>
		<paragraph><![CDATA[• upgrading U.S. 29 to Interstate 785 in Guilford and ]]></paragraph>
		<paragraph><![CDATA[Rockingham counties. ]]></paragraph>
		<paragraph><![CDATA[A complete breakdown of the projects in the draft ]]></paragraph>
		<paragraph><![CDATA[plan, as well as changes from the current 2018-2027 ]]></paragraph>
		<paragraph><![CDATA[STIP, is available on the NCDOT website. ]]></paragraph>
		<paragraph><![CDATA[Each of the department’s 14 highway divisions will ]]></paragraph>
		<paragraph><![CDATA[schedule an in-house week-long public comment ses- ]]></paragraph>
		<paragraph><![CDATA[sion in February or March during normal business hours. ]]></paragraph>
		<paragraph><![CDATA[The sessions will serve as opportunities for interested ]]></paragraph>
		<paragraph><![CDATA[residents to review maps and handouts about the pro- ]]></paragraph>
		<paragraph><![CDATA[jects, ask questions of local NCDOT staff, and submit ]]></paragraph>
		<paragraph><![CDATA[comments. There will also be an opportunity for resi- ]]></paragraph>
		<paragraph><![CDATA[dents to submit comments online, with those details ]]></paragraph>
		<paragraph><![CDATA[being announced later. ]]></paragraph>
		<paragraph><![CDATA[Projects that did not score high enough to be funded ]]></paragraph>
		<paragraph><![CDATA[at the statewide level are rolled over to the regional ]]></paragraph>
		<paragraph><![CDATA[level to be considered for funding. Projects that were ]]></paragraph>
		<paragraph><![CDATA[not funded at the regional level could still be considered ]]></paragraph>
		<paragraph><![CDATA[at the division level. This cascading aspect of the pro- ]]></paragraph>

		<paragraph><![CDATA[business up to an expensive risk. ]]></paragraph>
		<paragraph><![CDATA[According to Lawyers Weekly, in ]]></paragraph>
		<paragraph><![CDATA[2016 one of the largest settlements ]]></paragraph>

		<paragraph><![CDATA[thresholds which were inaccessible ]]></paragraph>
		<paragraph><![CDATA[to people with disabilities. ]]></paragraph>
		<paragraph><![CDATA[Numerous other cases around ]]></paragraph>
		<paragraph><![CDATA[the country have resulted in own- ]]></paragraph>
		<paragraph><![CDATA[ers, contractors, and designers pay- ]]></paragraph>
		<paragraph><![CDATA[ing out hundreds of thousands of ]]></paragraph>

		<paragraph><![CDATA[lions. You can’t afford to be un- ]]></paragraph>
		<paragraph><![CDATA[aware of this law. ]]></paragraph>
		<paragraph><![CDATA[Fair housing law basics ]]></paragraph>
		<paragraph><![CDATA[The NCFHA is relatively short. ]]></paragraph>
		<paragraph><![CDATA[This state law shouldn’t be con- ]]></paragraph>
		<paragraph><![CDATA[fused with the better-known federal ]]></paragraph>
		<paragraph><![CDATA[Fair Housing Act. The federal ]]></paragraph>
		<paragraph><![CDATA[statute, however, allows individual ]]></paragraph>
		<paragraph><![CDATA[states to adopt and enforce their ]]></paragraph>
		<paragraph><![CDATA[own comparable statute instead of ]]></paragraph>
		<paragraph><![CDATA[relying on the federal act. ]]></paragraph>
		<paragraph><![CDATA[Our state’s fair housing laws are ]]></paragraph>
		<paragraph><![CDATA[enforced by the N.C. Human Rela- ]]></paragraph>
		<paragraph><![CDATA[tions Commission, a state govern- ]]></paragraph>
		<paragraph><![CDATA[ment agency within the Office of ]]></paragraph>
		<paragraph><![CDATA[Administrative Hearings. The com- ]]></paragraph>
		<paragraph><![CDATA[mission has a professional staff of ]]></paragraph>
		<paragraph><![CDATA[investigators and attorneys as well ]]></paragraph>
		<paragraph><![CDATA[as commissioners appointed by the ]]></paragraph>
		<paragraph><![CDATA[governor and legislature. Enforce- ]]></paragraph>
		<paragraph><![CDATA[ment is carried out by commission ]]></paragraph>

		<paragraph><![CDATA[The most important thing to ]]></paragraph>
		<paragraph><![CDATA[know about the NCFHA is how ]]></paragraph>
		<paragraph><![CDATA[broad it is. The act outlaws a wide ]]></paragraph>
		<paragraph><![CDATA[range of discriminatory housing ]]></paragraph>
		<paragraph><![CDATA[practices based on race, color, reli- ]]></paragraph>
		<paragraph><![CDATA[gion, sex, national origin, handicap- ]]></paragraph>

		<paragraph><![CDATA[entirely a question of design. A con- ]]></paragraph>
		<paragraph><![CDATA[tractor, on the other hand, would ]]></paragraph>
		<paragraph><![CDATA[seem to have no liability for accessi- ]]></paragraph>
		<paragraph><![CDATA[bility. Under the venerable Spearin ]]></paragraph>
		<paragraph><![CDATA[doctrine a contractor is only re- ]]></paragraph>
		<paragraph><![CDATA[quired to build the project according ]]></paragraph>
		<paragraph><![CDATA[to the plans designed the by archi- ]]></paragraph>
		<paragraph><![CDATA[tect and provided by the owner. A ]]></paragraph>
		<paragraph><![CDATA[contractor is seemingly the least ]]></paragraph>
		<paragraph><![CDATA[culpable party when design stan- ]]></paragraph>
		<paragraph><![CDATA[dards aren’t met. ]]></paragraph>
		<paragraph><![CDATA[But the current practice of the ]]></paragraph>
		<paragraph><![CDATA[N.C. Human Relations Commission ]]></paragraph>
		<paragraph><![CDATA[staff, supported by federal case law, ]]></paragraph>
		<paragraph><![CDATA[is to seek relief against all the major ]]></paragraph>
		<paragraph><![CDATA[parties involved in the project— ]]></paragraph>
		<paragraph><![CDATA[owner, designer, and contractor. ]]></paragraph>
		<paragraph><![CDATA[Neither the North Carolina statute ]]></paragraph>
		<paragraph><![CDATA[nor state decisional law specifically ]]></paragraph>
		<paragraph><![CDATA[authorizes this practice. However, ]]></paragraph>
		<paragraph><![CDATA[federal courts interpreting the fed- ]]></paragraph>
		<paragraph><![CDATA[eral act have determined that a con- ]]></paragraph>
		<paragraph><![CDATA[tractor can (surprisingly) be held li- ]]></paragraph>
		<paragraph><![CDATA[able even if the contractor did noth- ]]></paragraph>

		<paragraph><![CDATA[The rationale for this approach is ]]></paragraph>
		<paragraph><![CDATA[that the Fair Housing Act is remedial ]]></paragraph>
		<paragraph><![CDATA[in nature and a strict interpretation ]]></paragraph>
		<paragraph><![CDATA[of the act will result in compliance ]]></paragraph>
		<paragraph><![CDATA[with the law and an increase in ]]></paragraph>
		<paragraph><![CDATA[available housing for handicapped ]]></paragraph>
		<paragraph><![CDATA[individuals. Even so, this approach ]]></paragraph>
		<paragraph><![CDATA[totally upends the traditional divi- ]]></paragraph>
		<paragraph><![CDATA[sion of responsibilities on a design- ]]></paragraph>
		<paragraph><![CDATA[bid-build construction project. ]]></paragraph>
		<paragraph><![CDATA[Despite this persuasive authority, ]]></paragraph>
		<paragraph><![CDATA[a contractor facing a claim under ]]></paragraph>
		<paragraph><![CDATA[the NCFHA should still raise a de- ]]></paragraph>
		<paragraph><![CDATA[fense based on the implied war- ]]></paragraph>
		<paragraph><![CDATA[ranty of plans and specifications. ]]></paragraph>
		<paragraph><![CDATA[This defense is well established ]]></paragraph>

		<paragraph><![CDATA[make comments before the com- ]]></paragraph>
		<paragraph><![CDATA[mission investigators issue a deter- ]]></paragraph>
		<paragraph><![CDATA[mination. In addition, by including all proj- ]]></paragraph>
		<paragraph><![CDATA[ect participants, the respondents ]]></paragraph>
