                        "data": "I’m sure many readers are looking forward to "
                    },
                    {
                        "data": "the Christmas holiday break, after an intense year "
                    },
                    {
                        "data": "with challenges associated with growth and suc- "
                    },
                    {
                        "data": "cess – labor shortages, and competing demands "
                    },
                    {
                        "data": "for subtrades and suppliers. As well, in the classic "
                    },
                    {
                        "data": "combination of crisis and opportunity, the storm "
                    },
                    {
                        "data": "damage from hurricanes and flooding has created "
                    },
                    {
                        "data": "plenty of work for the industry – notably the $1.7 "
                    },
                    {
                        "data": "billion in military construction projects as the US "
                    },
                    {
                        "data": "Navy rebuilds from Hurricane Florence. "
                    },
                    {
                        "data": "Dodge Data & Analytics predicts things will "
                    },
                    {
                        "data": "slow down somewhat in 2020. The good news is "
                    },
                    {
                        "data": "that the economists there aren’t projecting a hard- "
                    },
                    {
                        "data": "landing recession; in part because of all of the "
                    },
                    {
                        "data": "work in the pipeline that has yet to start or reach "
                    },
                    {
                        "data": "the completion stages. The slower pace may give "
                    },
                    {
                        "data": "you the opportunity to catch your breath, though. "
                    },
                    {
                        "data": "I’ve been watching major longer-range trends "
                    },
                    {
                        "data": "that promise to reshape the industry, namely the "
                    },
                    {
                        "data": "increasing importance of modular and factory- "
                    },
                    {
                        "data": "built construction, and integrated technologically "
                    },
                    {
                        "data": "focused design and construction systems. Artifi- "
                    },
                    {
                        "data": "cial intelligence also will redefine much of our in- "
                    },
                    {
                        "data": "dustry. Despite these changes, however, this is a time "
                    },
                    {
                        "data": "of year when we can slow our business pace "
                    },
                    {
                        "data": "somewhat, and spend more time with our fami- "
                    },
                    {
                        "data": "lies. I will need to think how I will delegate re- "
                    },
                    {
                        "data": "sponsibilities (or somehow manage directly the "
                    },
                    {
                        "data": "production of the next issue), while I am in the "
                    },
                    {
                        "data": "South Pacific and Australia/New Zealand on a va- "
                    },
                    {
                        "data": "cation from mid-January through early March. Al- "
                    },
                    {
                        "data": "though your holiday and vacation plans may not "
                    },
                    {
                        "data": "be quite as adventurous, I hope you’ll enjoy the "
                    },

                    },

                        "data": "level of the Great Recession: Dodge "

                        "data": "The chief economist for Dodge Data & Analytics of- "
                    },
                    {
                        "data": "fered an outlook for the US construction industry in "
                    },
                    {
                        "data": "2020 on Oct. 31, and his perception is that there will be "
                    },
                    {
                        "data": "a decline in most sectors – but this slowdown will not "
                    },
                    {
                        "data": "be a severe crash and, in part, is caused by a skilled "
                    },
                    {
                        "data": "labour shortage. "
                    },
                    {
                        "data": "“The recovery in construction starts that began dur- "
                    },
                    {
                        "data": "ing 2010 in the aftermath of the Great Recession is "
                    },
                    {
                        "data": "coming to an end,” said Richard Branch at the 81st an- "
                    },
                    {
                        "data": "nual Dodge Outlook Conference in Chicago. "
                    },
                    {
                        "data": "“Easing economic growth driven by mounting trade "
                    },
                    {
                        "data": "tensions and lack of skilled labor will lead to a broad "
                    },
                    {
                        "data": "based, but orderly pullback in construction starts in "
                    },
                    {
                        "data": "2020,” Branch said. “After increasing 3% in 2018, "
                    },
                    {
                        "data": "construction starts dipped an estimated 1% in 2019 "
                    },
                    {
                        "data": "and will fall 4% in 2020.” "
                    },
                    {
                        "data": "“Next year, however, will not be a repeat of what the "
                    },
                    {
                        "data": "construction industry endured during the Great Reces- "
                    },
                    {
                        "data": "sion. Economic growth is slowing, but is not anticipated "
                    },
                    {
                        "data": "to contract next year. Construction starts, therefore, will "
                    },
                    {
                        "data": "decline but the level of activity will remain close to re- "
                    },
                    {
                        "data": "cent highs. By major construction sector, the dollar "
                    },
                    {
                        "data": "value of starts for residential buildings will be down 6%, "
                    },
                    {
                        "data": "while starts for both nonresidential buildings and non "
                    },
                    {
                        "data": "building construction will drop 3%.” "
                    },
                    {
                        "data": "The pattern of construction starts for more specific "
                    },
                    {
                        "data": "segments is as follows: "
                    },
                    {
                        "data": "The dollar value of single family housing starts will be "
                    },
                    {
                        "data": "down 3% in 2020 and the number of units will also lose "
                    },
                    {
                        "data": "5% to 765,000 (Dodge basis). Affordability issues and "
                    },
                    {
                        "data": "the tight supply of entry level homes have kept demand "
                    },
                    {
                        "data": "for homes muted and buyers on the sidelines. "
                    },
                    {
                        "data": "Multifamily construction was an early leader in the re- "
                    },
                    {
                        "data": "covery, stringing together eight years of growth since "
                    },
                    {
                        "data": "2009. However, multifamily vacancy rates have moved "
                    },
                    {
                        "data": "sideways over the past year, suggesting that slower "
                    },
                    {
                        "data": "economic growth will weigh on the market in 2020. "
                    },
                    {
                        "data": "Multifamily starts are slated to drop 13% in dollars and "
                    },
                    {
                        "data": "15% in units to 410,000 (Dodge basis). "
                    },
                    {
                        "data": "The dollar value of commercial building starts will re- "
                    },
                    {
                        "data": "treat 6% in 2020. The steepest declines will occur in "
                    },
                    {
                        "data": "commercial warehouses and hotels, while the decline in "
                    },
                    {
                        "data": "office construction will be cushioned by high value data "
                    },
                    {
                        "data": "center construction. Retail activity will also fall in 2020, "
                    },
                    {
                        "data": "a continuation of a trend brought about by systemic "
                    },
                    {
                        "data": "changes in the industry. "
                    },
                    {
                        "data": "In 2020, institutional construction starts will essen- "
                    },
                    {
                        "data": "tially remain even with the 2019 level as the influence of "
                    },
                    {
                        "data": "public dollars adds stability to the outlook. Education "
                    },
                    {
                        "data": "building and health facility starts should continue to see "
                    },
                    {
                        "data": "modest growth next year, offset by declines in recre- "
                    },
                    {
                        "data": "ation and transportation buildings. "
                    },
                    {
                        "data": "The dollar value of manufacturing plant construction "
                    },
                    {
                        "data": "will slip 2% in 2020 following an estimated decline of "
                    },
                    {
                        "data": "29% in 2019. Rising trade tensions has tilted this sector "
                    },
                    {
                        "data": "to the downside with recent data, both domestic and "
                    },
                    {
                        "data": "globally, suggesting the manufacturing sector is in con- "
                    },
                    {
                        "data": "traction. Public works construction starts will move 4% higher "
                    },
                    {
                        "data": "in 2020 with growth continuing across all project types. "
                    },
                    {
                        "data": "By and large, recent federal appropriations have kept "
                    },
                    {
                        "data": "funding for public works construction either steady or "
                    },
                    {
                        "data": "slightly higher – translating into continued growth in en- "
                    },
                    {
                        "data": "vironmental and transportation infrastructure starts. "
                    },
                    {
                        "data": "Electric utilities/gas plants will drop 27% in 2020 fol- "
                    },
                    {
                        "data": "lowing growth of 83% in 2019 as several large LNG ex- "
                    },
                    {
                        "data": "port facilities and new wind projects broke ground.’ "
                    },
                    {
                        "data": "In his presentation, Branch provided a word graph in- "
                    },
                    {
                        "data": "dicating that construction executives currently believe "
                    },
                    {
                        "data": "the skilled labour shortage is their greatest impediment "
                    },
                    {
                        "data": "to growth. However, there are other factors and risks, "
                    },
                    {
                        "data": "including increased trade tensions and monetary policy "
                    },
                    {
                        "data": "challenges, that could add to economic stresses in the "
                    },
                    {
                        "data": "months ahead. "

                        "data": "tinctive, state-of-the-art, technologically-advanced "
                    },

                    },

                        "data": "21st century library, use them to learn and grow to the "
                    },

                        "data": "General Assembly re-wrote the pri- "
                    },
                    {
                        "data": "mary statute governing the enforce- "
                    },
                    {
                        "data": "ability of indemnity provisions in "
                    },
                    {
                        "data": "construction and design contracts. "
                    },
                    {
                        "data": "The legislation, signed into law by "
                    },
                    {
                        "data": "Gov. Roy Cooper on July 8, 2019, "
                    },
                    {
                        "data": "both expanded and restricted the "
                    },
                    {
                        "data": "permissible scope of certain indem- "
                    },
                    {
                        "data": "nity agreements. "
                    },
                    {
                        "data": "House Bill 871 (ratified as S.L. "
                    },
                    {
                        "data": "2019-92) amended N.C. Gen. Stat. "
                    },
                    {
                        "data": "§22B-1, North Carolina’s “anti-in- "
                    },
                    {
                        "data": "demnity” statute. "
                    },
                    {
                        "data": "The legislation added new sub- "
                    },
                    {
                        "data": "sections to §22B-1 that (1) render "
                    },
                    {
                        "data": "unenforceable agreements requir- "
                    },
                    {
                        "data": "ing design professionals to defend "
                    },
                    {
                        "data": "others for claims arising from the "
                    },

                        "data": "designer’s actions; and (2) authorize "
                    },

                    },
                    {
                        "data": "It is common in contracts in the "
                    },
                    {
                        "data": "construction industry that one party "
                    },
                    {
                        "data": "(indemnitor) will expressly agree in "
                    },
                    {
                        "data": "its contract to “indemnify and hold "
                    },
                    {
                        "data": "harmless” the other party to the "
                    },
                    {
                        "data": "contract (indemnitee) for damages "
                    },
                    {
                        "data": "the indemnitee incurs from claims "
                    },
                    {
                        "data": "brought against the indemnitee by a "
                    },
                    {
                        "data": "third party arising from actions of "
                    },
                    {
                        "data": "the indemnitor. For example, a de- "
                    },
                    {
                        "data": "signer may agree in its contract "
                    },
                    {
                        "data": "with the project owner to indemnify "
                    },
                    {
                        "data": "the owner for damages in the event "
                    },
                    {
                        "data": "a third party is injured and sues the "
                    },
                    {
                        "data": "owner for damages caused by the "
                    },
                    {
                        "data": "designer’s alleged negligence. "
                    },
                    {
                        "data": "Commonly coupled with this obli- "
                    },
                    {
                        "data": "gation to indemnify is the duty to "
                    },
                    {
                        "data": "defend. The duty to defend is dis- "
                    },

                        "data": "tinct from the obligation to indem- "
                    },

                        "data": "nify. Whereas the obligation to "
                    },

                        "data": "indemnify essentially requires the "
                    },
                    {
                        "data": "indemnitor to reimburse the indem- "
                    },

                        "data": "nitee for losses, damages and ex- "
                    },

                    },

                    },

                    },

                        "data": "designer to indemnify others, but "
                    },
                    {
                        "data": "the duty to defend has been de- "
                    },
                    {
                        "data": "clared “against public policy, void, "
                    },
                    {
                        "data": "and unenforceable.” "
                    },

                        "data": "This prohibition applies only to "
                    },
                    {
                        "data": "certain design professionals; and it "
                    },
                    {
                        "data": "does not apply to others in the con- "
                    },
                    {
                        "data": "struction industry such as contrac- "
                    },
                    {
                        "data": "tors, subcontractors or suppliers. "
                    },
                    {
                        "data": "Attorneys’ fees "
                    },
                    {
                        "data": "The focus of much of the com- "
                    },
                    {
                        "data": "mentary in the industry on the "
                    },
                    {
                        "data": "amended statute has been on the "
                    },
                    {
                        "data": "prohibition of requiring design pro- "
                    },
                    {
                        "data": "fessionals to defend others against "
                    },
                    {
                        "data": "third-party claims. Of equal or per- "
                    },
                    {
                        "data": "haps greater significance was the "
                    },
                    {
                        "data": "addition of a new section to the "
                    },
                    {
                        "data": "statute, §22B-1(d), that expressly au- "
                    },
                    {
                        "data": "thorizes an award of attorneys’ fees "
                    },
                    {
                        "data": "in the context of indemnification. "
                    },
                    {
                        "data": "Entitlement to recover attorneys’ "
                    },
                    {
                        "data": "fees is regulated by statute and is "
                    },
                    {
                        "data": "permissible in only limited circum- "
                    },
                    {
                        "data": "stances. Prior to this amendment, "
                    },
                    {
                        "data": "the anti-indemnity statute did not "
                    },
                    {
                        "data": "address whether an agreement to "
                    },
                    {
                        "data": "reimburse an indemnitee for its at- "
                    },
                    {
                        "data": "torneys’ fees incurred in defending "
                    },
                    {
                        "data": "third-party claims was enforceable. "
                    },

                        "data": "The statute was silent on this issue. "
                    },

                        "data": "The amended statute now ex- "
                    },

                        "data": "pressly validates indemnity agree- "
                    },

                        "data": "ments that require the indemnitor "
                    },

                    },

                    },

                    },

                    },

                        "data": "indemnitee, there is now a statutory "
                    },

                        "data": "pronouncement validating contrac- "
                    },
